Agreement between the Russian Federation and Republic of Kazakhstan on IP

There is an Agreement between the Government of the Russian Federation and the Government of the Republic of Kazakhstan on cooperation in the field of industrial property protection (Moscow, March 28, 1994).

According to Article 8. when filing applications for the issuance of titles of protection, obtaining titles of title, and maintaining them in force, patent attorneys of both states, on the basis of reciprocity, can deal directly with the patent offices of the Parties while representing only the interests of national applicants. National applicants of one state, in the manner prescribed by its legislation, are also granted the right, on the basis of the principle of reciprocity, to conduct cases for obtaining titles of protection and maintaining them in force directly with the patent office of the other Party.

Thus, I can only conduct business as a patent attorney in the interests of Kazakhstani applicants. The interests of foreign parties in the Russian Federation, I do not have the right to conduct.

Article 3

In the field of industrial property protection, natural and legal persons of one state shall enjoy in the territory of another state the same rights and benefits that are currently granted or will be granted by the legislation of that other state to its own natural and legal persons, using the same remedies on those on the same grounds and to the same extent.

At the same time, on issues not regulated by this Agreement, the Parties will apply the provisions of the Paris Convention for the Protection of Industrial Property, revised in Stockholm on July 14, 1967.

To introduce office work, I need to receive an electronic signature (EDS) for a foreign citizen in Russia.

Step-by-step instructions for obtaining an EDS for a non-resident. Actions and steps that must be taken to obtain an EDS for a passport holder of another state:

-          Obtaining SNILS. SNILS is the insurance number of an individual personal account with the Pension Fund of the Russian Federation.

-          Obtaining a TIN. TIN - individual taxpayer number. The TIN is needed to account for income and taxes paid by a foreign citizen. Temporary residence permit in the Russian Federation or Residence permit of a foreign citizen.

Based on these documents Passport (and its translation), SNILS, and any of the above, a foreign citizen must contact the certification center of the Business Network to obtain an electronic signature certificate. The personal presence of a person in the certification center is required to obtain an electronic signature.  A foreign citizen can write down an EDS key on an external medium - a token, JaСarta or issue an electronic signature certificate on his own on his home computer and even on a regular "flash drive" through the personal account of the "Business Network" system.
